What seemed like an issue reserved for the entertainment industry is becoming relevant for any organization. According to the Gartner Predicts 2026 analysis, by 2028 at least one major company will claim the right to create and maintain AI avatars of all its employees, replicating their knowledge and skills, and this will force employment contracts to include clauses on digital identity.<\/p>\n<\/section>\n<section>\n<h2>What is an employee AI avatar<\/h2>\n<p>An employee AI avatar is a digital representation of a real person built through computer-generated imagery, natural language processing, emotion AI, and voice synthesis. It gives the organization the ability to scale the impact of a single employee even when geographic or linguistic barriers exist.<\/p>\n<p>Until recently, AI avatars represented generic digital entities, not identified individuals. They were used for internal communications, such as executive team messages, for onboarding, and for customer support. Technological evolution is making something far more specific possible: building the professional persona of a real individual from their digital footprint accumulated over the years.<\/p>\n<\/section>\n<section>\n<h2>Your digital footprint as training data<\/h2>\n<p>Over the course of years working in an organization, every employee generates a significant volume of digital content: meeting transcripts, emails, chats, presentation recordings, documents. These assets contain enough signal about a person&#8217;s skills, communication style, and knowledge base to enable, even if only partially, the construction of their professional persona. What is significant, Gartner points out, is that this is possible even after the person has left the company.<\/p>\n<p>The AI avatar market already includes vendors such as NVIDIA, Synthesia, D-ID, Soul Machines, and others. As the technology matures and no-code platforms make building personalized digital workers more accessible, the number of organizations technically capable of doing this will grow rapidly.<\/p>\n<\/section>\n<section>\n<h2>The legal and contractual gap<\/h2>\n<p>The digital replication of an employee&#8217;s identity, decision-making style, and personal expertise creates an area of uncertainty around how emerging legal policies will develop, intersect, and potentially conflict with privacy regulations, data protection, and emerging rights related to biometric data and personality. Some U.S. states have already introduced laws to protect individuals&#8217; right not to be preserved in AI form.<\/p>\n<p>Standard employment contracts do not cover these scenarios. The question of who owns the digital representation of a person, whether the employee or the organization, does not yet have a consolidated regulatory answer in most jurisdictions.<\/p>\n<\/section>\n<section>\n<h2>How to prepare now<\/h2>\n<p>Gartner recommends that organizations start an internal dialogue on how employee data is used to enable AI tools, stress-test existing employment contracts against scenarios where AI can replicate elements of human skills, and define clear boundaries for avatar use to protect both the organization and employees. For high-value roles, understanding how content produced by employees can be used as training data, in compliance with current regulations, is already an urgent issue today.<\/p>\n<p>The starting point is transparency: clearly communicating to employees how their data is used in AI enablement processes is both a requirement for organizational trust and, in many contexts, a regulatory obligation.<\/p>\n<\/section>\n<section class=\"conclusione\">\n<h2>The takeaway<\/h2>\n<p>Employee AI avatars are not science fiction. They are a technological direction that is already feasible and, in some sectors, already being pursued. Organizations that do not address the legal, ethical, and contractual implications of this scenario now will find themselves managing complex situations in a regulatory environment that is still evolving.
